
LEGAL FRAMEWORK
TERMS
I. Contractual Scope
This document constitutes the contract for the provision of tourism services between the client and ALPINE TREKS PERÚ. By hiring our services, the client declares under oath to have read, understood, and accepted the clauses stipulated in this legal framework.
II. Reservations and Financial Obligations
For the binding confirmation of any expedition, a deposit equivalent to 30% of the total transaction value is required. The remaining balance must be settled in full in a single payment at least 48 hours prior to the start of the itinerary. Failure to pay entitles the company to terminate the contract without right to refund.
III. Cancellation Regime and Penalty Clause
Contractual terminations by the client will be subject to the following scale of retentions:
- More than 30 days prior: 20% deposit retention for administrative expenses.
- Between 15 and 29 days prior: 50% deposit retention.
- Less than 14 days or 'No Show': 100% deposit retention.
IV. Disclaimer and Force Majeure
ALPINE TREKS PERÚ is exempt from liability in the event of force majeure or fortuitous cases, including but not limited to natural disasters, strikes, route closures by authorities, or extreme weather conditions that prevent the safe conduct of the activity. In such events, the company will seek logistical alternatives but is not obligated to return financial payment for services already rendered.
V. Jurisdiction and Competence
For any controversy arising from the interpretation or execution of this contract, the parties expressly submit to the jurisdiction of the competent courts of the city of Huaraz, Ancash, Peru, waiving any other jurisdiction that may correspond to them.
